The stakes

The client faced Super Extreme DUI exposure under ARS § 28-1382(A)(2) in Desert Ridge Justice Court. Super Extreme DUI sits at the top of the C1M DUI hierarchy and carries 45 days mandatory jail with 31 days suspendable on IID completion, leaving 14 days actual served, an 18-month judge-ordered ignition interlock device, MADD VIP attendance, full DUI counseling, the highest C1M fine tier, and a permanent Super Extreme DUI record on every background check.

What we did

Future First negotiated the case down two full tiers from Super Extreme DUI to Standard DUI under ARS § 28-1381(A)(1). The client served 1 day jail instead of the 14-day Super Extreme floor, paid roughly $1,495 in fines and assessments on a payment plan, and was not required to complete MADD VIP or formal DUI counseling. 13 jail days saved. Set aside under ARS § 13-905 available after sentence completion and fines paid. Sealing records under ARS § 13-911 eligible approximately 2028, three years after IID removal.

If you’re facing a Super Extreme DUI in Arizona

Two-tier reductions from Super Extreme down to Standard DUI are the strongest defense outcome on a Super Extreme case short of full charge dismissal. Super Extreme is the top tier of the C1M DUI hierarchy and carries the highest fines, the longest IID requirement, and the most jail days at the statutory floor. Standard DUI under § 28-1381(A)(1) is the bottom DUI tier and dramatically reduces every consequence category.

Eliminating the MADD VIP requirement and the formal DUI counseling order is unusual on any DUI plea. When defense counsel structures the deviation request to address screening risk factors in advance, the prosecutor and judge sometimes accept a counseling-free disposition for first-offense Standard DUI cases. The 1-day jail term is the statutory floor for Standard DUI, the minimum any Standard DUI conviction can carry.
