A five-count DUI case at Scottsdale City Court could have produced two stacked DUI convictions plus three traffic counts. Future First narrowed the case to a single DUI count, dismissed all four companion counts, then came back in 2020 and got the probation terminated early.

The stakes

The client faced five charges in Scottsdale City Court after a 2019 traffic stop: an ARS § 28-1381(A)(1) DUI, an ARS § 28-1381(A)(2) DUI .08 or more count, and three traffic counts (Fail to Drive on Right Side of Road, Control Devices, One Way Road Violation).

A first-offense DUI conviction in Arizona carries up to 10 days in jail, fines and surcharges around $1,500 to $2,000, a 12-month ignition interlock requirement, MADD victim impact panel, alcohol screening and treatment, license suspension, and probation up to 5 years. A DUI conviction also carries lifetime collateral consequences for employment, insurance, and licensing. Stacked companion counts compound the fine exposure and add points to the driving record.

What we did

After Future First negotiated the plea and pressed the State on its proof, all four companion counts were dismissed. The client pled to the single A1 DUI count. The court suspended 9 of 10 jail days on completion of treatment and screening, imposed $1,598.20 in fines and fees, ordered a 12-month IID, MADD panel, alcohol screening, and 16-hour Program-Level II treatment.

The firm then filed and won a Petition for Early Termination of Probation in 2020. The client is eligible to set aside the conviction under ARS § 13-905 now and eligible to seal the record under ARS § 13-911 starting in 2023.

If you’re facing a multi-count DUI in Arizona

Arizona DUI cases routinely include companion counts that the State stacks on top of the lead DUI charges. The two DUI counts under § 28-1381(A)(1) and § 28-1381(A)(2) are typically alternate-theory counts (impairment to slightest degree vs BAC .08 or more), and one of them usually drops out by plea. The companion civil traffic counts produce separate fines and license points.

Two layers of defense work usually move these cases. First, the plea negotiation should narrow the case to a single DUI count and dismiss every companion count. Second, after the client completes the conditions of the sentence cleanly, a Petition for Early Termination of Probation can shorten the probation term and accelerate eligibility for set aside and sealing.
