The stakes

The client faced three Class 1 misdemeanor DUI counts in Mesa Municipal Court: a DUI Liquor/Drugs count under ARS § 28-1381(A)(1), a DUI BAC .08 or more count under ARS § 28-1381(A)(2), and an Extreme DUI count under ARS § 28-1382(A)(1). The Extreme DUI count carries 30 days mandatory jail with 21 days suspendable on ignition interlock compliance, fines and assessments around $2,743, a 12-month judge-ordered ignition interlock, MADD victim impact panel, alcohol screening and counseling, and a license suspension.

What we did

After Future First negotiated the plea and pressed the State on its proof, the State dismissed both standard DUI counts under ARS § 28-1381(A)(1) and (A)(2). The client pled to the Extreme DUI count only. The court imposed 30 days jail with 21 days suspended (2 days straight time + 7 days home detention through the Tempe Home Detention Program), $2,804 in fines on a payment plan, no probation, and alcohol counseling through Prodigy Healthcare. The firm also secured waiver of jail costs from the State.

Set aside under ARS § 13-905 is eligible after all non-financial sentence terms complete. Sealing records under ARS § 13-911 is eligible approximately 2026, three years after the one-year judge-ordered IID ends.

What our clients say

Future First Criminal Law has earned hundreds of five-star reviews from clients across Arizona. Read our verified Google reviews or see what past clients have said on our client reviews page.

If you’re facing an Extreme DUI in Arizona

The Tempe Home Detention Program is one of the strongest sentencing tools available on Extreme DUI sentences when the conviction itself cannot be avoided. The client serves a portion of the jail term on electronic monitoring at home rather than in custody. On a 9-day Extreme floor, defense work that secures home detention can cut in-custody time to 2 days or fewer while satisfying the statutory minimum.

Jail-cost waivers are negotiated separately from the sentence itself. Arizona jails bill defendants for actual incarceration costs. Total jail cost on an Extreme DUI sentence can run $1,000+ depending on the facility. Defense work that secures a waiver from the State eliminates that financial burden.

Future First Criminal Law has handled Extreme DUI cases across Maricopa County and Arizona. We know how Mesa Municipal Court and other municipal courts evaluate home detention requests and how to negotiate jail-cost waivers.
