The stakes

The client was charged in Phoenix Municipal Court after a single-vehicle crash. The reported blood alcohol concentration was in the Extreme range, which moved the case into ARS § 28-1382(A)(1). The State filed multiple counts, including the Extreme DUI, a standard impairment DUI, and a 0.08 DUI, along with two civil traffic counts.

An Extreme DUI is the second most serious misdemeanor DUI in Arizona. A conviction carries a mandatory minimum of 30 consecutive days in jail. The court cannot suspend below that floor the way it can on a standard first DUI. The charge also carries higher fines and mandatory assessments, a 12-month ignition interlock requirement, mandatory alcohol screening and treatment, a Victim Impact Panel, a license suspension, and a permanent DUI conviction. The 30-day jail floor was the single biggest exposure in the case.

What we did

Future First worked the discovery and built a mitigation package for the prosecutor and the court. The firm flagged problems in the stop and the field testing, documented the client’s early completion of alcohol screening and counseling, and pushed a written deviation request.

The State dismissed the Extreme DUI count. The client pled to a standard 0.08 DUI under ARS § 28-1381(A)(2), a Class 1 Misdemeanor. That single move took the case off the 30-day Extreme jail floor and back onto the standard DUI track. The court imposed 10 days in jail with 9 suspended on completion of screening and counseling, so the client served one day. The court reduced the jail costs to $250 and held restitution open for 120 days. The client accepted a 12-month ignition interlock device and a 90-day license action. With the Phoenix Extreme DUI Reduced to a standard DUI, the mandatory month in jail came off the table.

Set aside under ARS § 13-905 is available after the client completes all court requirements. Arrest record sealing under ARS § 13-911 is eligible approximately 2029, three years after counseling is complete.

If you’re facing a Phoenix Extreme DUI

An Extreme DUI in Arizona is a BAC of .15 or more under ARS § 28-1382. The line between a standard DUI and an Extreme DUI is a single blood or breath number, and that number changes the mandatory jail floor from one day to 30. The reading is not the end of the case. Blood draws, breath devices, the timing of the test, and the stop itself all give a defense lawyer room to challenge the result or to argue for a reduction. Getting a Phoenix Extreme DUI reduced to a standard DUI is the difference between a mandatory month in jail and a single day.

A charge reduction from Extreme to standard is not automatic. It comes from working the file, finding the weak points in the State’s case, and putting a real mitigation package in front of the prosecutor. The earlier you start screening and counseling, the stronger that package is at the table.

Every case turns on its own facts. This result reflects this client’s record and this evidence. It does not promise the same outcome in another case.
