A prefile DUI investigation in Buckeye carried 2nd-offense DUI exposure on top of a prior 2021 Goodyear DUI, which would have triggered 90 days mandatory jail, mandatory license revocation, and an open door to felony 3rd-offense charging on any future incident. Future First worked the prefile stage and the State filed nothing.

The stakes

The client was the subject of a prefile DUI investigation by Buckeye Police. If charges had been filed, the client would have faced standard DUI exposure: minimum 10 consecutive days jail under ARS § 28-1381(I) with up to 9 suspendable, a 12-month judge-ordered ignition interlock device, base fines starting at $1,250 plus 84 percent surcharges and assessments totaling over $2,000, MADD Victim Impact Panel, supervised probation up to five years, mandatory alcohol screening and treatment, automatic driver license suspension, insurance rate increases, and a permanent DUI conviction. The exposure was sharpened by a prior 2021 Goodyear DUI on the client’s record, which would have triggered the 2nd-offense enhancement under ARS § 28-1381(K) and added 90 days mandatory jail with 60 suspendable, mandatory 1-year license revocation, and elevated future-DUI exposure to felony 3rd-offense under ARS § 28-1383.

What we did

Future First represented the client throughout the prefile investigation. The firm controlled the client’s interaction with Buckeye investigators, advised on rights, and built the defense before charges were filed. After the firm’s prefile defense work, the State never filed charges on the Buckeye matter. No 2nd-offense escalation. No conviction. No jail. No fine. No probation. No IID. Set aside under ARS § 13-905 does not apply because no conviction was entered. Arrest record sealing under ARS § 13-911 available immediately on the prefile matter.

The client also has a prior 2021 Goodyear DUI conviction that is separately eligible for arrest record sealing under § 13-911 on the standard DUI sealing wait timeline. Future First can pursue that sealing petition as a separate matter to clean up both records.

If you’re under a 2nd-offense DUI prefile investigation in Arizona

2nd-offense DUI exposure is significantly heavier than 1st-offense DUI exposure. The mandatory jail floor jumps from 10 days to 90 days. The license consequence escalates from suspension to revocation. The future-DUI track moves into felony Aggravated DUI territory under ARS § 28-1383. A 2nd-offense DUI conviction on the record permanently restructures the consequence math on any subsequent DUI incident.

Preventing a 2nd-offense filing at the prefile stage produces an outsized benefit. Not only does the client avoid all consequences of the current investigation, but the prior-count window for future incidents stays at “one prior” rather than “two priors,” which means a future DUI would face 2nd-offense enhancement rather than felony 3rd-offense charging. The protective effect of a successful prefile defense compounds over time.

The prior 2021 Goodyear DUI conviction is separately eligible for arrest record sealing under § 13-911 on the standard DUI sealing wait timeline. Sealing the prior conviction record alongside the current prefile matter cleans up both incidents in the public record.
