Three stacked F4 Aggravated DUI counts carried 60 days of prison, $5,000 in fines, and 18 months of probation in the State’s original offer. Each count individually carries the Class 4 Felony consequences under ARS § 28-1383, including a permanent felony record, loss of civil rights, federal firearm prohibition for life, mandatory MVD license revocation, IID requirement, and a permanent felony bar that surfaces on every employment, housing, professional licensing, and immigration screen. Multi-count Felony Aggravated DUI charges are common when the State charges the same incident under multiple subsections of ARS § 28-1383. Each subsection captures a distinct aggravator (suspended license, child passenger, third DUI within 84 months, wrong way driving) and each subsection can support a separate count even when the underlying conduct is a single DUI incident. The result is a charging document with multiple parallel felony counts.
Dropping companion counts at the plea stage is the standard defense move on a multi-count F-DUI case. The State retains one F-DUI count covering the underlying impaired-driving conduct, the other counts are dismissed, and the client pleads to a single felony rather than multiple. The dismissed counts cannot be refiled and do not appear on the conviction record.
The 50-day reduction in prison time on this case came from negotiating the sentencing structure on the single retained count. 10 days of prison instead of 60 represents a major reduction in custody time.
