The stakes

The client faced three Class 3 felony Aggravated Assault counts under ARS § 13-1204(A)(2) at Maricopa County Superior Court, charged with deadly weapon or dangerous instrument allegations. Aggravated Assault with a deadly weapon falls under the dangerous offense sentencing range under ARS § 13-704, carrying 5 to 25 years of prison per count (presumptive 7.5 years), fines up to $150,000 plus surcharges per count, restitution, mandatory community supervision after release, a lifetime federal firearm prohibition, and a permanent felony record with lifetime collateral consequences for employment, housing, immigration, and civil rights.

What we did

After Future First negotiated the plea and pressed the State across all three counts, the State agreed to a global resolution: Count 3 dismissed; Counts 1 and 2 amended for plea. Count 1 received a stipulated 3.5 years of prison with 40 days of presentence credit; Count 2 received 2 years of supervised probation to begin upon release from prison. The firm also secured the elimination of post-prison community supervision (which typically runs an additional year on top of any prison sentence) and reduction of the monthly probation fee to $30. Final court financial obligations totaled $64 in assessments. The firm pulled the sentence substantially below the presumptive prison range for a Class 3 dangerous-offense conviction and prevented the three counts from running consecutively.

If you’re facing Class 3 Dangerous Aggravated Assault charges in Arizona

Arizona’s dangerous-offense sentencing range under ARS § 13-704 produces some of the harshest sentences in the state. A Class 3 dangerous felony conviction carries 5 to 25 years of prison on a first-time offender — significantly higher than the non-dangerous Class 3 range. The dangerous designation attaches when the offense involves a deadly weapon, dangerous instrument, or other aggravating element specified in the statute.

Global resolution work across multiple dangerous-offense counts is the most powerful defense tool available. Each count carries its own sentencing range, and the default expectation on multi-count dangerous-offense cases is consecutive prison time. When the State agrees to a global plea, the case can collapse into one stipulated sentence with concurrent or staged structure (prison + post-release probation) that dramatically reduces the total exposure.

Eliminating post-prison community supervision under ARS § 13-603(K) saves the client an additional year of correctional oversight after release. The savings come on top of the stipulated sentence reduction, the count dismissal, and any other negotiated provisions.
