Two separate Class 6 felony Drug Paraphernalia cases would have produced stacked back-to-back prison sentences. Future First negotiated a global plea with concurrent probation on both cases and an undesignated felony structure that preserves the misdemeanor designation path.

The stakes

The client faced two separate Class 6 felony Drug Paraphernalia Possession or Use cases under ARS § 13-3415(A) at Maricopa County Superior Court (filed in 2020 and 2023). Each Class 6 felony conviction carries 4 months to 2 years of prison (presumptive 1 year per count), supervised probation eligibility, fines up to $150,000 plus surcharges, restitution, immigration consequences, and a permanent felony record on designation with lifetime collateral consequences. Two cases stacked consecutively would have produced multiple years of prison exposure.

What we did

After Future First negotiated the plea structure across both cases, the State agreed to 2 years supervised probation concurrent on both cases, with both counts structured as Class 6 Undesignated Felonies under ARS § 13-604. The client received probation in lieu of prison, with substance abuse treatment required.

The firm prevented the cases from running consecutively and structured both felony counts as undesignated so successful probation completion would open the door to misdemeanor designation. Set aside under ARS § 13-905 is eligible after probation discharge in December 2025. Sealing records under ARS § 13-911 is eligible approximately 2028, three years after sentence completion under the anticipated misdemeanor designation.

If you’re facing multiple Class 6 felony drug cases in Arizona

Global plea structures are the most powerful defense tool when a client has more than one pending felony case. Each case can stand on its own for sentencing, and the default expectation in many courts is consecutive sentencing. Coordinated negotiation across cases lets the defense lock in a concurrent structure where the sentences run side-by-side instead of stacking back-to-back.

The undesignated felony framework under ARS § 13-604 adds a second layer of relief. When the State agrees to plead the cases as Class 6 undesignated felonies, the court has discretion at discharge to designate each as a misdemeanor. Successful completion of probation triggers the designation path. The convictions stay on the record but at the misdemeanor level, which dramatically reduces collateral consequences and shortens the sealing wait.

Future First Criminal Law has handled multi-case felony resolutions across Maricopa County. We know how MCAO evaluates global plea requests on drug paraphernalia and other Class 6 felonies, and how to structure the plea so both cases close as concurrent undesignated felonies with a clear path to misdemeanor designation.
