FOURTH AMENDMENT PROTECTIONS AND EXCEPTIONS
The Fourth Amendment to the United States Constitution has three main purposes: One, it protects the person, the home and one’s belongings; two, it prohibits unreasonable searches and seizures; and three, it requires warrants that are based on probable cause and specifically describe the place to be searched and the items to be seized.
If evidence is illegally obtained in violation of the protections of the Fourth Amendment, then the Exclusionary Rule will prevent that evidence from being used against you in court. Be aware, though, that there are many exceptions to the warrant requirement and the Exclusionary Rule.
This chart describes the analysis used to determine whether law enforcement conducted a lawful search and seizure and, if not, whether the evidence obtained by the police can be excluded or “suppressed.”
